1. Maintenance: Plant Doctor will provide weekly maintenance for those plants listed on Schedule A attached. Weekly maintenance includes watering, pruning, trimming, rotating, feeding, controlling insects and diseases and cleaning. This service will be performed according to a mutually satisfactory schedule. Please be confident that Plant Doctor holds a current NYSDEC pesticide certification should the need arise.
2. Client Requirements: Unsoftened hot and cold water outlets must be made available to Plant Doctor staff during regular working hours. Client will please inform their employees and cleaning staff that only Plant Doctor personnel are to water and care for listed plants. Any plant changes in location must have approval from Plant Doctor.
3. Plant Replacement Policy: Plant Doctor will replace those plants that show signs of deterioration during the term of this agreement with plants of the same general size, appearance and value. Plant Doctor reserves the right to change the variety of the plant when circumstances make another plant more suitable. Plant Doctor is not responsible for deterioration of plants caused by theft, vandalism, fire, acts of God, temperature extremes for plants that are above ninety-five or below fifty-five degrees Fahrenheit. Our replacement policy is effective immediately after installation of plants supplied by Plant Doctor. If Plant Doctor is servicing existing plantings, the replacement policy is effective for those plants six months after commencement of service.
4. Term of Agreement: This agreement will begin upon plant arrival and be in effect for one year unless otherwise stipulated. The agreement will be renewed automatically unless written either party gives notification 30 days prior to the annual termination date. Either party has the right to terminate this agreement at any time with 30 days written notice and full payment of fees.
5. Charges and Terms: Maintenance charges for each week of the contract will be agreed upon. Client will be billed monthly on the first day of that month with payment being expected within the month billed. There will be a 2% finance fee for all payments over 30 days and a charge of $25. for returned checks.
6. Purchases require a 50% deposit upon order.
7. Exotic Plant Exchanges will be listed on Schedule B and will occur monthly to quarterly as needed.
